Open Company in China: China Eases Company Registration Rules for Foreign Companies

Foreign-invested companies in China will see an easing of company registration requirements based on the principle of national treatment, according to according to Zhang Mao, head of China’s State Administration of Industry and Commerce (SAIC). He also clarified that those policies also apply to foreign businesses.

Based on the national treatment principle, foreign companies are entitled to the same policies as their Chinese counterparts enjoy, meaning, when the Chinese government eases the setting-up requirements for Chinese companies, foreign investors should receive the same treatment.

The reform of the company capital registration system includes the following areas:

    Lowering the registered capital requirements for setting up a company; 
    Replacing the current annual inspection system of enterprises with an annual reporting system; 
    Relaxing business premise registration requirements for market players; 
    Facilitating the establishment of an enterprise credit system; and 
    Promoting the subscribed capital contribution registration system.

China will relax the thresholds of registered capital, the minimum registration capital of RMB30,000 for limited liability companies will be canceled, as well as the RMB100,000 minimum for single shareholder companies and the RMB5 million minimum for joint stock companies. Besides, the requirements for business premise registration will be simplified.

Moreover, measures will be taken to reduce the costs of business set-ups, and meanwhile, efforts will be made to build an integrity system whereby enterprises that violate the law will be put on a “blacklist” and be announced to the public.

The reform aims to lower market entry requirements while reinforcing the responsibility of market players. It is also part of the central government’s commitment to move away from the current “emphasizing approval while neglecting regulation” mode to “easier market access and reinforced supervision” mode.

The number of foreign companies newly established in China this year stood at 16,351 as of September 2013, representing a 9.29 percent decrease compared with the same period last year.

China Work Visa: Illegal Foreign Worker Expelled from China

A foreigner in Beijing has been given a 7-day detention and a fine of 6,500 yuan ($1,070) for traffic violations and illegal employment and will be deported along with his father after serving the term, said police.

The foreigner, whose nationality and name haven't been disclosed, hit a middle-aged Chinese woman at the Zuojiazhuang intersection in Chaoyang district when riding a scooter on Dec 2.

The man was also detained for 7 days and fined 1,500 yuan for other breaches of the traffic regulations, as during their investigation into the accident the police found the foreigner had neither a driving license nor a motorbike plate and he was carrying a passenger on a scooter.

Police also found that the man and his father were working illegally. So he was detained for another 5 days and fined 5,000 yuan; his father was detained for 14 days and fined 10,000 yuan. The company that illegally hired the pair fined up to 20,000 yuan. Both the man and his father are to be deported on their release, the police said.

The police said expatriates in China should comply with the country's laws and regulations. Police protect their rights, but they will also keep lawful management of them and crack down on illegal behavior to maintain social order.

Every country is happy to see foreign visitors whose activities comply with the local laws, but unreliable foreigners should not be made welcome.

But although offenders are subject to criminal liability and deportation, the financial penalties are not severe. Under the provisions of the exit-entry law, foreigners staying in the country illegally may be given a warning before being fined, or a 500 yuan fine levied for each day they overstay. In severe cases the fine may be as high as RMB 10,000 and individuals could face detention for a period of between 5 to 15 days, and employers may be fined RMB 10,000 for every illegal foreigner they employ up to a maximum fine of RMB 100,000. Any monetary gains that have resulted from the employment of such individuals will also be forfeit.

Small, Micro Enterprises in China Enjoy VAT&BT Exemptions

In July’s State Council meeting held by Chinese Prime Minister Li Keqiang, it was decided that all eligible small and micro-sized enterprises in the country will be temporarily exempted from value added tax (VAT) and business tax (BT) starting August 1, 2013. The policy is only temporary for now, but the State Council has announced that a similar long-term policy is currently being worked on.

This temporary policy basically allows eligible small and micro-sized enterprises to now enjoy the same tax policies as sole proprietorships, and the State Council has estimated that the new policy will benefit more than 6 million small and micro-sized enterprises with regards to employment and revenues. Specifically, it calls for small-scale VAT taxpayers and BT taxpayers (i.e., ones that achieve less than RMB20,000 in total monthly sales) to be exempted from VAT and BT beginning August 1.

How to Get a China Visa on Arrival from Hong Kong?

I come from Indonesia, and I've never been to China before and plan to visit Guangzhou, China for business this year. I've heard that we can apply for Visa on Arrival in HongKong to enter the mainland of China. My questions are:

1. Can I also enter Guangzhou by using that visa?
2. How many days can I stay in China (Guangzhou and Shenzhen) by using that visa?
3. How much does it cost and how long does it take to get that visa ready to be used since the moment I apply it? (let's say I come very early on that day).

ps: I don't want to apply for visa to China in Jakarta but Hong kong since I stay far from Jakarta.

Someone will probably come on and give a better answer, but here is what I know.

China visa from Hong kong

You have separate Visa's for Hong Kong SAR to mainland China, but once you get you China visa that allows you to travel to all parts of China that aren't listed as SAR. That is most places, including Guangzhou and Shenzhen. You can apply for a China visa in Hong Kong. I did mine through a visa agency called HiTouch Consulting, I imagine you can do the same. From memory, the visa is different prices depending what country your from and how long you wanna stay there. At least, I know the Americans had to pay more that what I did (hahaha). I can't remember how much I paid (not too much though), and I'm not on an Indonesian passport any way, so its probably different.

There is a difference between applying for visas in Hong Kong and your own country. If you apply in your own country, you can get a 6 months multiple entry visa that allows to to travel in and out of China as many times as you like within those 6 months. In Hong Kong you can only get single or double entry visas valid from 3 months to 1 year long. What is more, China visa is much more easier to apply in Hong Kong than in your own country.The biggest strongpoint of applying a China visa fromHong Kong is all things done in one day. what kind of visa is best if I want to stay one year in China? What are the requirements? I have no degrees. So what kind of work can I get with work visa or maybe I can open a buisnes?

I'm going to China this year and I want to know the easiest way to get a China visa to stay there for one year long. If you are in the similar situation, the purpose of this post is to save you time hopefully.

Generally speaking, you need to apply for a China visa from the nearest Chinese consulate or embassy. Why & How American Need to Get China Visa to Go to China?

If you are an American citizen and you will be flying from the New York to China, is he required to get a China visa to do that?

Yes, a China visa is required for an American citizen to visit mainland China. However, if you will not be exiting the airport in China, such as if you have a connecting flight to another country, then you do not need a China visa. Also, Hong Kong, Macau, and Taiwan do not require a visa from American citizens.

All visitors traveling to mainland China whether for business or pleasure, require a visa. The best way to make sure you can go to China successfully is to get a China visa first and make a flight reservation later.

Chinese authorities expect you to obey the terms of the visa. This means if you have go to China on a tourist visa, you cannot work or become a full-time student. If you violate the terms, you could be fined or imprisoned. If you are plan to go to China to do business or just stay longer there for a long time, you need to get a business (F) visa.

You can apply for a China visa either through the Chinese Embassy or Consulates and your passport will be kept. As for time, it depends on what kind of service you will choose. Or you can find an agent to help you to apply for China visa and the agent will charge some money for the visa service. Unless you live near a Chinese embassy and you decide to apply your visa yourself, then it will cost less. And most of American can't get a However, the China visa policy will be changed since July 2013, because of the establishment of (Exit-Entry Administration Law of the People's Republic of China), which means you might have lower chances to get one year China visa from then on.
